Warrant Against Aamir Khan………
In a country with lakhs of cases are pending in all courts, a local court in Indore issued bailable warrant against Aamir Khan for disrespecting the national flag. In a function organised by a showroom of a leading car maker Aamir Khan was the chief guest and 11 national flags were hoisted on top of the showroom. The flags remained hoisted even after the sunset(How many patriotic Indians know that this should not be done)? The attention of the showroom owners was drawn towards the issue. Now comes the twist in the tale- the flags were allegedly pulled down in a “derogatory manner” and remained on the floor. This is the violation of the national flag code. A complaint in this regard was filed by an advocate under Prevention of Insult to the National Honour Act. I am not mentioning the name of the advocate so that I don’t give him publicity.
It is an attempt to gain publicity by harassing a celebrity. Such people should be punished by the court. Holding the owners of the showroom is fine but Amir Khan? He was the chief guest. Was Aamir Khan the one who pulled the flag down and let it lay on the floor. During the Independence day celebrations, so many people carry small paper flags and the next day we find them find them on the roads or in the garbage bins. On the traffic lights in Delhi there are so many people selling plastic Tricolours. What happens to them? Doesn’t matter because ordinary Indian on the road is not capable of giving anybody publicity. Richard Gere is issued a warrant for kissing Shilpa Shetty- the judge and the concerned advocate is a celebrity. You can watch them on national TV. The advocate should be punished for wasting precious time of the honourable court and the judge should be punished for giving importance to such frivolous issues. They don’t waste any time in giving judgements in such cases where as important issues just linger on.

hehe, this is kind of ridiculous
Good of you not to mention his name, he would have gotten what he was looking for.

You got to be kidding me here. Any dull witted person can tell the real intentions behind this ridiculous case. Are these people actually qualified enough to sit on the judges seat.
Duzzit has anything to do with the big controversy which happened last year at the time of the release of FANA ?

Thing is, the law is the law.. no matter how silly, ridiculous or unfair it is.

Thanks Bharath and Rajiv for your views. Ammar, judicairy had nothing to do with the Fanaa issue. They played a positive role in that. This incident happened recently.

This is just so ridiculous! And more than filing the complaint is the fact that the court actually issued a warrant for aamir! It’s really a case of passing the buck around, and the axe falling on the most famous person present there.
Reminds me of this case recently, where a man sued a laundry for several million dollars for losing a pant. No dearth of crazy people in this world.

yeah i heard about that one… pple sue each other for anything

Mr.Rajiv, this is not just anything, i wonder how can you say that. Amir was supposed to be an intelligent and responsible citizen. His only hard luck is that unlike most cases in india,he could not use his name-fame etc to save himself from warrant.

//How many patriotic Indians know that this should not be done//
I didn’t.
//I am not mentioning the name of the advocate so that I don’t give him publicity.//
Thanks so much! Unlike everyone else…
//The advocate should be punished for wasting precious time of the honourable court and the judge should be punished for giving importance to such frivolous issues.//
Prerna: I don’t know what to say! You’ve left me speechless! I just love, I mean love, this post…great!

Maddy, I was referring to amreekandesi’s million dollar pants example
Some people have even been sued for moaning their lawn on sundays -which disturbed the neighbors- lol
Even if the flag code wasn’t respected perfectly, don’t you think it has gone a little too far to become a national issue?
September 29, 2007 at 1:38 pm
hooohhh… such things are not new…lets forget such cases…such acts are made to sell news and publicity…well aamir khan was not on the media for so long after “the dam issue”…now,he too got negative publicity…bcos we knw that he is innocent..so no question of tarnishing his image.

How dare they issue a warrant for a farmer? I think all Indian farmers should join hands and protest this.

The sweet irony was that the man who sued was a judge. And he lost.

I don’t know. If my next-door neighbor mowed his lawn on his private property at 5 am in the morning every Sunday (his right), and if he was not amenable to or inconsiderate of my right of sleeping in late without noise pollution on my private property, and continued to do so even after being made aware of my concerns, I’d sue him too. Not saying this is what happened in the case you mentioned, but suing someone for lawnmower noise in itself is not that unreasonable - depends on the circumstances. A little give-and-take is necessary when living with others, though everyone draws the line differently.

If you’re in for soem good time, check out this site:
http://www.AmericanLawsuits.com
Introduction:
Welcome to AmericanLawsuits.com. Home of the most ridicolous lawsuits ever filed. Heard of Stella, the old lady who sued McDonalds for millions when she spilled hot coffe on herself? Well that’s nothing compared to some of these lawsuits. Use the menu at the left to check them out.
Here are a few:
Some ***** put glue all over the toilet seat at a restaurant in Colorado. The next customer, of course, got stuck when he sat down. The customer admitted that it wasn’t the restaurants fault, but he sued them for $3 million anyway.
Two girl scouts had baked cookies for their “scout-team!?” and was giving them away for free to everyone in the neighbourhood. One of their neighbors got so scared when she heard them knock on the door that she sued them for 900 dollars, and won!
A lady from Illinois was attacked by a bird outside a store, causing her some head injuries. She sued the store for 100k but the case was thrown out (for once, the American legal system worked).
Some jerk from Minnesota is suing David Copperfield, the magician, demanding that he reveals his secrets to him. If he doesn’t, he demands 50 mill. dollars because David somehow steals his “godly” powers from the plaintif, who actually believes that he is god.
You can check the site for more. Among other things, America definately is the land of lawsuits!

Rajiv, agreed that many of the lawsuits seem frivolous. There are two issues here:
1. Freedom to sue someone - that ensures anyone and everyone who thinks he has a valid case can sue, including those that are finally decided as frivolous or without merit.
2. Law of the land - the courts deciding that a lawsuit has merit or not, and then deciding on it.
If we want freedom, then it goes with it that frivolous lawsuits will be filed, along with many genuine ones - there’s no way to allow only “valid” lawsuits to be filed. There’s nothing one can do about it, other than to have a chuckle or express some frustration.
The second part is where we can do something about it, as new laws are always being made and old ones modified.
Speaking for myself, I prefer 1. to having limited freedom to sue someone, though the corporations increasingly deciding who can sue and who cannot - by influencing the laws to penalize people if they lose - a deterrent that will limit people’s freedom to sue.
September 30, 2007 at 4:20 pm
@ Amit:
A deterent would be be useful indeed, because people in America sometimes tend to start lawsuits without even trying to settle things with the other person (like the neighbors call the cops instead of calling you or knoocking at your door if you’re making some noise late at night).
I also think the deterent shouldn’t be too restrictive though, because no matter how right you are, trial is held by men and the law isn’t always just (it tries to be
)
I agree with what you said for yourself.
September 30, 2007 at 6:39 pm
Rajiv, a deterrent is good if it discourages frivolous lawsuits. But if a deterrent is used to discourage not-rich & not-powerful people to sue powerful corporations for valid reasons, then it’s a limit on freedom and I’m against it - I’ll take the crazies if it gives greater freedom and no limitation on valid lawsuits. Erring on the side of caution in this case.
